Terms and Conditions of Service
These Terms and Conditions ("Agreement") govern the provision of services by Jordyn Cumner trading as ThatsJordyn (ABN 23 874 337 958) ("we", "us", "our", "the Business") through our website www.thatsjordyn.com ("Website") and related platforms including Patreon, email subscriptions, and any other service offering. By accessing or purchasing our services, you (“Client”, “you”) agree to these Terms.
1. Payment Terms
Payment must be made via an accepted method (e.g., Visa, Mastercard, Stripe, PayPal, or other secure payment processors integrated via Squarespace or Patreon).
Payments must be made in full prior to the commencement of services unless otherwise agreed.
Late payments may incur additional fees, interest, or result in cancellation of services.
All prices are in Australian Dollars (AUD) and include GST where applicable.
2. Consumer Guarantees (Australian Consumer Law)
Nothing in this Agreement excludes or restricts any rights under the Australian Consumer Law (ACL).
Where services do not meet the consumer guarantees under the ACL, we may (at our election):
Re-supply the services; or
50% Refund the cost of the services.
These remedies do not limit your rights under the ACL.
3. Client Responsibilities
Clients must provide accurate, complete information for bookings and services.
Clients must be reasonably available, review work, and provide timely feedback to prevent delays.
You agree to ensure that all content shared with us (for styling, publication, or use) is owned or licensed by you.
4. Refunds and Satisfaction Guarantee
If dissatisfied within the first 45 minutes of a Style Experience, you may be eligible for a 50% refund of the service fee.
Refunds do not apply to completed or digital services unless otherwise stated.
All refund requests must be made in writing to info@thatsjordyn.com within 48 hours of service delivery. Refunds will only be considered if accompanied by reasonable justification.
5. Service Cancellation, No-Shows, and Rescheduling
Appointments cancelled with less than 24 hours' notice will be charged in full.
If you arrive more than 20 minutes late, the session may be cancelled to protect the schedule of other clients. No refund will be issued, but a credit may be applied toward future bookings (within 3 months).
No-shows with no communication will not be eligible for a refund or rescheduling.
Exceptions for emergencies may be made on a case-by-case basis.
6. Termination and Right of Refusal
Either party may terminate this Agreement at any time by providing written notice.
If terminated by the Client, payment is required for all services rendered up to the termination date.
We reserve the right to refuse service or terminate the Agreement in cases of abuse, non-cooperation, inappropriate conduct, or breach of these terms.
7. Modifications to the Agreement
Any amendments must be made in writing and accepted by both parties (email is sufficient).
We reserve the right to update these Terms. Continued use of our services following updates constitutes acceptance.
8. Confidentiality
All personal information, styling notes, and business-related data shared between the parties is confidential.
We respect your privacy and handle all data in accordance with our Privacy Policy.
Confidentiality obligations continue beyond the termination of the Agreement.
9. Travel and Additional Expenses
Travel outside a 30 km radius from our base location will incur additional charges, which must be pre-approved by the Client in principle prior to commencement of services.
Such charges may include, but are not limited to, transportation, accommodation, and materials (e.g., garment purchases). Where exact costs are not known in advance, estimates will be provided in good faith.
All additional expenses will be itemised in a separate invoice and must be settled in full prior to the continuation or delivery of remaining services. The Consultant reserves the right to pause services if expenses are unpaid.
10. Third-Party Platforms and Digital Tools
We may use third-party platforms (e.g., Patreon, Squarespace, Google, Meta) for content, marketing, bookings, and communication.
You acknowledge that your use of third-party tools is also governed by those platforms' Terms and Policies.
11. Intellectual Property
All original content produced by ThatsJordyn (e.g., styling guides, photography, video, copywriting) remains our intellectual property unless explicitly transferred.
Clients are granted a limited, non-commercial license to use materials provided for personal use only.
Reproduction, resale, or commercial distribution without written permission is prohibited.
12. Jurisdiction
These Terms are governed by the laws of Australia, and the parties submit to the jurisdiction of its courts. These Terms comply with the Australian Consumer Law and any applicable international standards to the extent required.
